There were extraordinary scenes at the High Court' There were extraordinary scenes at the High Court's Chancery Division in London on 16 November 2020 as Peter Gillingwater, CEO of Newfound Global and Fintech 'thought leader' was accused of fabricating evidence and dismissed from the witness box as 'unreliable', looking red faced and completely flustered.

The dramatic scenes took place as part of civil proceedings against Mr Pete Gillingwater's brother in law, Mark Harrison and his estranged civil partner, former gay male prostitute Craig White. Mr Gillingwater was there to give supporting evidence for his brother-in-law but falsely and maliciously attributed child abuse allegations originally made against him by his own daughter to his ex brother-in-law (Mr. Kleinhentz) in a pre-meditated and malicious attempt to discredit him before the judge.

Another malicious and completely fictitious slur on Mr Kleinhentz, who is an NHS psychologist was that he tried to blackmail Mr. Harrison with his HIV status. This ‘evidence’ was submitted in a witness statement by Mark Sullivan of Keystone Law at the time but dropped as the first order of court business. This outrageous lie makes a mockery of Mr. Kleinhentz’s confidentiality obligations as a psychology professional.

We believe that Mr. Sullivan wasn’t sacked because these lies against an NHS professional working through a pandemic were utterly repugnant, but because it made Keystone Law look sleazy and incompetent. Mr Sullivan left the former Lawyer of the Year only after we brought these actions to light for several weeks. The company Directors have refused to investigate their internal communications after a formal complaint was made in writing to them about serious breaches of the SRA code of conduct.

The dispute was over an agreement between former long-term partners Mark Harrison and Thain Kleinhentz, who was told to leave a West London property they shared together for 15 years by Mark Harrison's father after their relationship ended. Mr Kleinhentz claims Mr Gillingwater threatened that 'the family would bury him with legal fees' if he took legal action, referring to the significant off-shore wealth of Don Harrison, Peter Gillingwater's father-in-law, Mark Harrison's father who lives as a tax exile in Monaco. This is despite Mr Kleinhentz having given up his job to care for Mark Harrison in 2005 when he needed lengthy hospital care and rehabilitation because his is HIV+ but received not one visit from any of his family members.

In his judgement High Court Judge Robin Vos described having "significant concerns" with Newfound Global CEO Mr Gillingwater's testimony and evidence. Judge Vos concluded in his order that "His (Peter Gillingwater's) witness statement contained some allegations in relation to a visit made by Thain Kleinhentz and Mr Cooper to Mr Gillingwater's house in June 2017. In his oral evidence, Mr Gillingwater professed not to be aware of the allegations contained in his witness statement. Later on in his oral evidence, Mr Gillingwater then said that he did remember the events which were the subject of the allegations. In addition to this Mr Gillingwater did not give straightforward answers to the questions which he was asked." Judge Vos concluded that he could only place "very little weight" on the evidence given by Mr Gillingwater due to its inconsistent and contradictory nature.

Mr Pete Gillingwater's disputed evidence took the form of an allegation that he apparently falsely made against Thain Kleinhentz and Darren Cooper. Mr Gillingwater unusually submitted two witness statements, the second of which contained the accusation that Mr Thain Kleinhentz and Mr Darren Cooper had loudly accused both him and his wife, Karen Gillingwater of abusing their own children when they visited his house in Orsett Terrace in Paddington in June 2017. These allegations were completely absent from Mr Gillingwater's first witness statement which was signed as being a true and accurate account of the proceedings by Mr Gillingwater himself just a few weeks earlier and submitted to the High Court of England and Wales.

In his cross examination of Mr Gillingwater Mr Kleinhentz's QC asked about the additions to the Newfound Global owner's second witness statement.

"This is a very serious allegation to accuse someone of isn't it. Are you sure that Mr Kleinhentz and Mr Cooper accused you and your wife of doing these things?

Peter Gillingwater turned bright red stuttering an answer and had to admit that this was a lie. His credibility in tatters he was dismissed from the witness box which he left at a gallop.

Mr Gillingwater's evidence was asked to be regarded as unreliable due to the various inconsistencies by the QC to Judge Vos. Mr Gillingwater was then summarily dismissed from the witness stand and he left the courtroom at speed. Judge Vos' comments about having 'significant concerns' regarding Mr Gillingwater's evidence speak volumes.
In fact according to the uncontested witness evidence it was Mark Harrison who told his ex-partner about the child abuse and drug dealing accusations which he said were made by his niece Aimee Gillingwater about her own father and that she had also accused her own mother (who he said suffered from bulimia) of starving her. Mark Harrison also revealed that Aimee Gillingwater was frequenting adult sex video chat sites where she was giving live 'performances' and that the police and social services had became involved at the family mansion in Paddington. He then labelled his brother in law Mr Gillingwater 'Pedo Pete', smirking when he did so.
When asked about the child sex show revelations her uncle made about her Aimee Gillingwater said there was ‘no proof’.

'I can't really understand why Peter Gillingwater would throw his own daughter under a bus for the rent boy his wife's brother married' said Mr Cooper 'but from my experience it really does sum up this family's priorities.’
'Mark Harrison said not only has Newfound Global lost money because people don't want to be associated with this kind of sleaze, but Aimee Gillingwater also lost her modelling contracts because her father used her childhood delinquency in a blisteringly vicious but incredibly stupid attack on an innocent man.'
Despite being aware of the actions of the UK Chair Kea New Zealand have refused to remove Mr. Gillingwater from their board. Kea NZ is sponsored by New Zealand Foreign Affairs and Trade, NZ Ministry of Business Employment and Innovation, New Zealand Trade and Enterprise, The University of Auckland, Aukland Unlimited, Air New Zealand, Topham Guerin, and DLA Piper.
When Craig White was questioned about selling male to male sexual services (despite this described as an outrageous accusation in a witness statement submitted by Mark Sullivan of Keysone Law) Mr White said he had previously been a sex worker. Craig White denied that Mark Harrison had ever paid him for the sexual services that he offered.
